Welcome to Nosh. These Terms of Service ("Terms") govern your use of the Nosh mobile application and website ("Service"), operated by The Golden Bubbie LLC ("Nosh," "we," "us," or "our"). By using the Service, you agree to these Terms.
Nosh is a food delivery platform connecting customers with local restaurants and independent delivery drivers. Nosh is not a restaurant, does not prepare food, and does not employ drivers. We are a technology platform that facilitates connections between independent parties.
You must be at least 18 years old to use Nosh. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate.
Restaurants and drivers pay a monthly subscription to access the platform. The first month is free. After the first month, a platform fee is deducted from earnings until the monthly subscription amount is met, after which remaining earnings are paid out in full.

Fees may change with at least 30 days' notice. Continued use of the Service after a fee change constitutes acceptance.
Payments are processed by Stripe. Customers are charged when the order is placed. Restaurants and drivers receive payouts according to the payout schedule described in the app. Refunds for cancelled or failed orders are handled on a case-by-case basis following our cancellation policy.
Drivers on the Nosh platform are independent contractors, not employees of Nosh. Drivers control when, where, and how they accept deliveries. Nosh does not provide vehicles, insurance, or benefits. Drivers are responsible for their own taxes, insurance, and compliance with local regulations.

Nosh takes safety seriously. Users can report safety concerns, misconduct, or emergencies through the app or by emailing hello@noshtheapp.com. We will investigate reports promptly and take appropriate action, which may include account suspension or removal. In emergencies, contact 911 directly.
To the maximum extent permitted by law, Nosh is not liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability for any claim is limited to the amount you paid Nosh in the 12 months preceding the claim.
You agree to indemnify and hold harmless Nosh, The Golden Bubbie LLC, and its affiliates from any claims arising from your use of the Service or violation of these Terms.
Most disputes can be resolved informally by contacting hello@noshtheapp.com. If a dispute cannot be resolved informally, it will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA) in New York, New York. You waive the right to a jury trial and to participate in class actions, except where prohibited by law.
These Terms are governed by the laws of the State of New York, without regard to conflict of laws principles.
If you downloaded Nosh from the Apple App Store, the following applies: You acknowledge that these Terms are between you and Nosh only, and not with Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms and may enforce them against you.
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.
